The Rhode Island Spring 2019 Aerial Imagery[1] is included in JOSM and is licensed as CC BY 4.0 [2], but there seems to be no waiver documented [3].

This ticket can be closed. The latest github posting on issue 1035 shows that the data is available openly, without a license. the CC BY 4.0 is for the webpage only.
